The Compensation Committee retained discretion to permit up to 25% of the total Option to vest as of March 20, 2010. On December 30, 2009, the Compensation Committee approved the vesting of 25% of the Option, resulting in the vesting of the Option as to 50,000 underlying shares on March 20, 2010. The vesting of the remaining 75% of the Option is contingent upon satisfaction of various performance criteria for the fiscal year ending December 31, 2009.
