- [F1]On October 17, 2002, the United States Bankruptcy Court for the District of Delaware confirmed the First Amended Plan of Reorganization under Chapter 11 of the Bankruptcy Code, as Further Revised, dated October 15, 2002 (the "Plan"), of the Issuer. The Plan became effective on the October 29, 2002. Under the Plan, each share of old Issuer common stock was cancelled and each holder of old Issuer common stock received .0057 shares of new Issuer common stock in the reorganized Issuer for each share of old Issuer common stock the holder previously owned. The Reporting Person previously reported that the Reporting Person's spouse had received one share of new Issuer common stock pursuant to the Plan to replace the old Issuer common stock previously held, when in fact the Reporting Person's spouse did not receive any shares pursuant to the Plan.
