Item 8.01. Other Events.

On August 16, 2007, DJO Incorporated (the “Company”) issued a press release reporting that on August 9, 2007, the U.S. Federal Trade Commission granted early termination of the waiting period under the Hart-Scott-Rodino Antitrust Improvements Act of 1976, as amended, for the proposed acquisition of the Company by an affiliate of ReAble Therapeutics, Inc. A copy of the press release is furnished as Exhibit 99.1 to this Current Report.

Additional Information About the Merger and Where to Find It

In connection with the proposed merger referred to in the press release, the Company intends to file a proxy statement with the SEC.
